Cancelling a Gym Membership in the Netherlands: The Rules (2026)

Cancelling your gym membership sounds simple, but in practice many people get stuck on small print, unclear notice periods or an unwilling reception desk. Your rights: the Wet Van Dam (since 2011)
Since 1 December 2011 the Netherlands has had the so-called Wet Van Dam (Van Dam Act). This law protects consumers against automatic long-term renewal of subscriptions. The essentials:
- No stilzwijgende verlenging (silent renewal, illegal since 2011) for longer than 1 month: a gym is not allowed to automatically renew your membership by a year after the initial contract term. At most it must convert into a monthly cancellable contract.
- Notice period at most 1 month: after the initial contract term the gym cannot require a notice period longer than 1 month.
- Written or digital cancellation: you may cancel via e-mail, registered post or the cancellation form on the website. A gym that only accepts “in person at the desk” is acting against the law.

Notice periods per chain
Below the notice periods that are common in 2026 at the large chains. Always check your own contract, as conditions can vary per membership type.
Basic-Fit:
- Flexible membership: 1-month notice period, so cancellable already after 1 month.
- 1-year contract: after the year, monthly cancellable with a 1-month notice period.

- Monthly membership: 1-month notice period, from the second month onwards.
- Annual contract: after 12 months monthly cancellable.
Fit For Free:
- Monthly: cancellable with a 1-month notice period.
- Annual membership: after the initial period monthly cancellable.
Anytime Fitness:
- Often works with a minimum contract of 12 months, then monthly cancellable.
Local and independent gyms:
- Vary widely. Some have a 6-month contract, but never longer than 1 month silent renewal automatically.
How do you officially cancel?
Steps to avoid hassle:
- Check your contract for the exact end date of the initial period.
- Count back: send your cancellation at least 1 month before the intended end date.
- Use a written or digital channel with proof of receipt. E-mail with read confirmation, cancellation form with confirmation e-mail, or registered post.
- Keep the proof for at least 6 months after cancellation.
- Check the first month after cancellation that no further debit takes place.
Template letter for cancellation
Below a text you can use:
Dear Sir/Madam,
I hereby cancel my membership at [name gym]. My membership number is [number], name [first and last name], date of birth [date].
I ask you to confirm the cancellation by e-mail to [your e-mail address]. In accordance with the Wet Van Dam, I assume that my membership ends on [date, at least 1 month after sending].

What if the gym pushes back?
Unfortunately, it regularly happens that a gym:
- Claims not to have received the cancellation.
- Demands that you come in person to cancel.
- Keeps debiting after the cancellation date.
- Uses a much longer notice period than is legally allowed.
What do you do then?
Step 1: Send a formal reminder in which you refer to the Wet Van Dam and your proof of earlier cancellation. Demand that debits stop.
Step 2: Stop the SEPA direct debit. You can withdraw a SEPA mandate at your bank or reverse a debited amount within 8 weeks. For unauthorised debits you have up to 13 months.

- Not checking whether the cancellation has been processed: monitor your bank statements for the first 2 months.
- Waiting too long to complain: the faster you react, the easier you get your money back.
What if you cannot train temporarily?
Sometimes you do not want to cancel, but to pause temporarily because of injury, pregnancy or a long stay abroad. Most chains offer options for this:
- Basic-Fit: pause option via the app, often 1 to 3 months, sometimes against a small fee.

- Local gyms: often arrange this via a personal conversation.
Ask about this before you cancel, because pausing is almost always cheaper than cancelling and signing up again later (avoid the registration fee!).
